Making A Still
How do I sell a car when still making payments?
I am considering selling a vehicle that I am still making payments on to a private party. Do any of you have knowledge of the procedures and any experience with this situation?
At any time- since you are the registered owner – you can sell your car to any one you’d like … It’s just gotta make sense to whom ever has a loan on it … example…
On the registration you’ll see the registered owners name … but right under neath that you’ll see the name of the lender to call to figure out what the payoff ( the amount you’ll need to pay the lender to get the title sent to you ) is… Next you have to either ask for every cent it takes to get the title from your buyer … Or you pay off the difference when you get the money from the new buyer ….. Once the exact loan is paid off the bank sends a form to the DMV and you .. It’s just a closing statement on loan …. You keep one for reciept..
Once the DMV gets the closing paperwork , they issue you a clear registration and finally the title ….
ALL THAT TAKES WEEKS = maybe 1 month
But once you get title you – sign it over to new guy on the spot ….. So that way the new buyer will go to dmv with Title and note of sale , to re-register it to him….
Now this is sounds frustrating- but if you sell the car today – put every little thing in writing (date – miles- vin – buyers/sellers name – price of sale – agreement to furbish title in said amount of days ) … Then if both of you are comfortable he can drive the car and keep in contact with you regarding the title …
There is a pro and con to both sides from the day you hand the car over …
For you – the seller – If he gets any parking tickets – accidents – hit and runs – robbery / murdering spree using your car and ditches it …… your screwed
For him is – you could take his money – say forget your loan/ credit – not pay any of it just to have the lender repo the car – he’s out x amount of dollars and a car… And your living in nowhereland on someone else’s social ….
FUNNY HOW LIFE IS ….
of course if this was the case everything in writing can be used in court to get you out – but it is still not worth the headache you give a judge and your self …..Plus the city always collects fine that are never reimbursed if you need their help and time…
